TERMS AND CONDITIONS

Welcome to TrackRec (“the Platform”), operated by TrackRec, Inc. (“TrackRec,” “we,” “us,” or “our”). The following Terms and Conditions (“Terms”) govern your access and use of the TrackRec website, mobile applications, and related services (collectively, the “Services”).

By accessing or using the Services, you (“User” or “you”) confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Services.

  1. Purpose of the Services

1.1 Sales Career Profiling
TrackRec is designed for sales professionals to document and present factual information about their sales achievements—such as roles, deal sizes, sales cycles, industries, territories, and more. By creating a profile, sales professionals (“Candidates”) can showcase relevant data (“User Content”) as they seek new opportunities.

1.2 Recruitment and Hiring
The Platform also enables recruiters, employers, or other entities (“Recruiters”) to post available sales positions with specific requirements (e.g., deal sizes, industries, inbound vs. outbound, etc.). TrackRec uses an algorithm to generate a “fit score” to help Recruiters evaluate candidate suitability based on the overlap between Candidates’ historical data and job requirements.

1.3 No Guarantee of Employment
TrackRec is a tool intended to connect Candidates with potential Recruiters. We do not guarantee employment, nor are we responsible for the outcome of any hiring process.

  1. User Eligibility and Accounts

2.1 Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By registering, you represent and warrant that you meet the applicable age requirement.

2.2 Account Registration
To use certain features, you may need to create an account. You agree to provide accurate, complete information and to keep your account information up to date. You are solely responsible for all activity on your account and for maintaining the confidentiality of your login credentials.

  1. User Content and Data Ownership

3.1 Ownership of Content
User Ownership: You retain ownership of the information, text, graphics, or other materials (collectively, “Content”) that you submit on the Platform.
License to TrackRec: By providing Content on or through the Services, you grant TrackRec a worldwide, non-exclusive, royalty-free, transferable license (with the right to sublicense) to use, reproduce, distribute, modify, adapt, create derivative works of, and publicly display such Content for the purpose of operating, promoting, and improving the Services.

3.2 Accuracy and Verification
TrackRec does not independently verify the legitimacy or accuracy of any Content provided by Users.
Candidates can choose to have parts of their experiences verified by peers, managers, colleagues, or clients through features provided by TrackRec.
Users acknowledge that any reliance on Content provided by others is at their own risk.

3.3 Voluntary Submission
All information you provide, including personal and professional details, is submitted voluntarily. You are responsible for ensuring that the Content you provide complies with all applicable laws and does not infringe or violate the rights of any third party.

  1. Salary Data and Anonymized Information

4.1 Salary Data Sharing
TrackRec may pool, anonymize, and aggregate salary-related data to provide the broader community with insights into compensation trends and benchmarks. Your personally identifiable information will not be disclosed in this process.

4.2 Community Benefit
Aggregated, anonymized data is used to help users understand market standards. You acknowledge that this process benefits the community by enhancing transparency and awareness of compensation levels.

  1. Restrictions on Use

5.1 No Competitive Analysis
The Platform is intended solely for recruiting and career advancement purposes. No Content provided on TrackRec may be used for competitive analysis or any other activities that undermine TrackRec’s purposes.

5.2 Prohibited Activities
When using the Services, you agree not to:

  • Post unlawful, misleading, or fraudulent information.
  • Scrape, crawl, or use any automated means to extract data for unauthorized purposes.
  • Engage in any activity that violates applicable laws, infringes intellectual property rights, or disrupts the operation of the Services.

5.3 No Affiliation with LinkedIn
TrackRec is not affiliated, associated, or endorsed by LinkedIn, Microsoft, or any of their subsidiaries. References to LinkedIn or any other third-party platforms do not imply any partnership or endorsement.

  1. Limitation of Liability

6.1 Disclaimer of Warranties
TrackRec provides the Services on an “as is” and “as available” basis. We make no warranties or representations, express or implied, about the reliability, accuracy, or completeness of the Services.

6.2 Limitation of Liability
To the maximum extent permitted by law, TrackRec, its officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of (or inability to use) the Services.

6.3 Indemnification
You agree to defend, indemnify, and hold harmless TrackRec from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, including your Content or any breach by you of these Terms.

  1. Modification and Termination

7.1 Changes to Terms
We may update these Terms at our discretion. If we make any material changes, we will notify you by posting an updated version on the Platform. Your continued use of the Services after changes become effective means you accept those changes.

7.2 Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, or for any other lawful reason.
